Terms of Use for HejBoat

1. What HejBoat offers

HejBoat helps guests find boats and contact operators. When you send an inquiry, the operator receives it by email and in their HejBoat Dashboard.

An inquiry is not a booking or reservation and does not confirm that the boat is available. HejBoat handles neither the rental agreement nor the payment. The guest and the operator agree on the price, dates and other terms themselves.

2. Information about boats and operators

The operator is responsible for ensuring that the information in the listing is accurate and up to date. This includes the description, photos, price, equipment and availability.

Before an agreement is made, the guest should have the relevant information confirmed directly by the operator. This may include, for example, the total price, any additional costs, licence or skipper requirements, security deposit, insurance and cancellation.

3. The agreement is made directly

If the guest and the operator agree on a rental, they enter into the agreement directly with each other. The operator sets the rental terms and receives any payment.

HejBoat is not a party to the rental agreement and does not receive payment for the boat rental. HejBoat cannot guarantee that a boat is available, that a listing contains all relevant information, or that the guest and the operator will reach an agreement.

4. Your account and your information

You must provide accurate information when you create an account or contact an operator. You are responsible for protecting your login details and for activity on your account.

You may not use HejBoat to share unlawful, misleading or offensive content. Nor may you share information that you do not have the right to disclose.

5. Listings and content

Operators are responsible for having the right to use the text, photos and other material they publish on HejBoat. They are also responsible for ensuring that listings comply with applicable rules and do not give a misleading impression of the boat or the rental.

HejBoat may review content that is reported or appears to breach these terms. We may correct, hide or remove content and restrict access to an account when necessary. Where possible, we provide an explanation when we do so.

6. Paid services

HejBoat does not charge for the boat rental itself. If HejBoat offers paid listings or subscriptions, they will be covered by separate terms on matters including price, payment, renewal and cancellation. Creating an account does not in itself create a paid subscription.

7. Personal data

HejBoat stores personal data within the EU and processes it in accordance with applicable data protection rules, including the EU General Data Protection Regulation (GDPR), known in Germany as DSGVO, and relevant supplementary German data protection rules.

When you send an inquiry, HejBoat shares the information it contains with the operator you contact. The operator receives the inquiry by email and in their HejBoat Dashboard. HejBoat does not disclose the information to unrelated parties.

8. Availability of HejBoat

We strive to keep HejBoat available and up to date. However, we cannot guarantee that the website will always work without interruptions or errors. We may change or close parts of the service when needed.

9. Liability

The operator is responsible for the boat, the listing and the terms of any rental. The guest and the operator are themselves responsible for determining whether the rental suits their needs and for complying with the agreement they enter into.

Nothing in these terms limits liability that cannot lawfully be limited.

10. Changes to the terms

We may update the terms if HejBoat changes or if new requirements arise. The current version will always be available on this page. In the event of significant changes, we will announce them on the website or in another appropriate way.

11. Contact, governing law and disputes

These terms are governed by Danish law, unless mandatory rules entitle you to protection under other legislation. Any disputes will be handled by the competent court in accordance with the applicable rules. These terms do not limit any rights you have under mandatory consumer law.

The possibility of complaining to an external complaints body depends on the nature of the complaint and the applicable rules.

Danish and English are legal versions of these terms. If the Danish and English versions differ, the Danish version prevails. Translations are approved by a HejBoat administrator; this is not legal approval. The final wording of this language clause requires legal review.
